Terms and Conditions

1. Scope

These General Terms and Conditions (GTC) apply to all orders placed by consumers (§ 13 German Civil Code, BGB) via the online shop of Maximilian Kuwertz (Shopify store at www.spells-ai.com).

2. Products

We sell books and merchandising items. All products are physical goods.

3. Conclusion of Contract

The presentation of the products in the online shop does not constitute a legally binding offer, but an invitation to place an order. By clicking the “Buy” button, you submit a binding offer to purchase the goods contained in the shopping cart. Confirmation of receipt of your order is sent immediately after submission by automated e-mail. The purchase contract is only concluded when we expressly confirm the order or deliver the goods.

4. Prices and Payment

All prices are in euros and include statutory VAT (where applicable under German law). Shipping costs are shown separately. Payment methods: PayPal and Shop Pay (credit card).

5. Shipping Countries

We deliver to Germany, to all member states of the European Union (Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain and Sweden) as well as to the following international countries: United Arab Emirates, Australia, Canada, Switzerland, United Kingdom, Hong Kong SAR, Israel, Japan, South Korea, Malaysia, Norway, New Zealand, Singapore, the United States of America (USA) and Ukraine. Deliveries to other countries are possible only on request and after individual confirmation.

6. Customs and Import Duties

For deliveries to non-EU countries, the buyer bears all applicable customs and import duties.

These cannot be calculated in advance and must be paid by the buyer to the competent authorities upon arrival of the shipment. We assume no responsibility for delays caused by customs authorities.

7. Delivery Times

We dispatch orders twice per week. Delivery time is approx. 2–5 business days within Germany, approx. 3–10 business days within the EU, and approx. 10–20 business days to the international countries listed above. For deliveries to non-EU countries, additional delays may occur due to customs clearance, over which we have no control.

8. Right of Withdrawal

Consumers have a statutory right of withdrawal of 14 days. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you, or a third party named by you who is not the carrier, have taken possession of the goods. To exercise your right of withdrawal, you must inform us (Maximilian Kuwertz, Katzbachstr. 4, 10965 Berlin, Germany, e-mail: support@spells-ai.com) by means of a clear statement (e.g. letter or e-mail) of your decision to withdraw from this contract. If you withdraw from this contract, we will refund all payments received from you, including delivery costs (with the exception of additional costs resulting from your choosing a type of delivery other than the standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received your notice of withdrawal. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise. We may withhold the refund until we have received the goods back or you have provided proof that you have returned the goods.

9. Return Costs

The buyer bears the direct costs of returning the goods.

10. Retention of Title

The goods remain our property until payment has been made in full.

11. Warranty and Complaints

The statutory warranty rights apply. In the event of defects or complaints, we will find an individual solution in the interest of the customer. Complaints can be sent by e-mail to support@spells- ai.com.

12. Applicable Law and Jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers with habitual residence in the EU, mandatory provisions of the respective country of residence also apply.

13. Contract Language

The contract language is German.

14. Dispute Resolution

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
